These Terms and Conditions (the “Terms”) govern your access to and use of our charging stations solution and related services (collectively, the “Service”), which are designed to recharge electric vehicles on demand.

By accessing or using the Service, you agree to be bound by these Terms and all applicable laws and regulations in the United Arab Emirates (UAE). If you do not agree with any part of these Terms, you must not use the Service.

2. Definitions

For the purpose of these Terms, the following definitions shall apply:

  • “Service” refers to the mobile application-based service provided by CHARGER ELECTRIC VEHICLES CHARGING STATIONS MANAGEMENT & OPERATION L.L.C for the charging of electric vehicles.
  • “User” means any individual or entity that uses the Service.
  • “Subscription” means the recurring service packages offered by the Company to the User.
  • “Instant Charge” refers to the immediate charging service option available to the User through the App.
  • “Scheduled Charge” refers to the charging service option that can be booked by the User for a future time.

3. User Registration

In order to use the Service, you must register and create an account on the App. During registration, you are required to provide truthful and accurate information about yourself and your electric vehicle, including but not limited to your name, contact details, vehicle model, and location. It is your responsibility to maintain the confidentiality of your account information and to promptly update any changes to ensure accuracy.

During registration, along with providing your personal details, you may also be asked to furnish additional profile information to access specific features including but not limited to:

  • Placing orders or booking services,
  • Your address,
  • Car details (including plate number),
  • Profile picture for your account (optional).

4. Service Description

Our Service offers a flexible and convenient charging solution for electric vehicle owners. Users must download the App and create an account to start the ordering process. Within the App, Users can set their location and provide details about their vehicle model to request an Instant Charge or schedule a charge for a later time. Additionally, we offer various Subscription Packages to accommodate different user needs and usage patterns. The Service also provides ancillary services such as car wash, insurance, towing, and tire services, which may be bundled with your charging subscription.

4.1 Services Across Geographies:

We offer our Services across various countries/locations (“Areas”) directly or indirectly through partners, franchisees, and/or licensees. The availability of these Services, including technical support and delivery times, may vary by geography. It’s important to note that some Services or options might not be available in your Area, as indicated on the Platform. We reserve the right to modify Services without

You can order Services through your Account on the Platform, selecting from available options, or by calling the provided phone number. It’s crucial to provide accurate information about your vehicle for proper service delivery. We outline specific obligations when ordering services, including vehicle care and preparation details, to ensure smooth service execution. This includes disclosing vehicle defects, removing valuables, ensuring insurance, and more, to mitigate any issues during service provision.

4.3 Specific Services Details:

  • Car Wash Services: When ordering car wash services, be aware of the care needed to prepare your vehicle, including removing valuables and informing our staff of any vehicle paintwork or material sensitivities.
  • Charge Delivery & Services: Our charging service comes with specific instructions for users, including ensuring safety measures are in place and following our guidelines to facilitate a successful charging session.
  • Tire Change Services: For those requiring tire change services, we’ve detailed the process, including payment confirmation and the handling of service delivery, emphasizing our partnership with third-party service providers for comprehensive after-sales support.

By following these guidelines and understanding the scope of our services, users can maximize the benefits offered by Charger, enjoying a seamless electric vehicle charging experience along with additional ancillary services designed for convenience and efficiency.

Beta Services

We occasionally offer access to ‘Beta Services,’ experimental features available for testing. These services are provided under specific terms, including disclaimers on reliability and warranties, to manage expectations while offering you the opportunity to experience the latest innovations.

5. Charging Options

There are two primary charging options available:

  • Instant Charge Option: This service is designed for Users who require immediate charging. Upon request, an available driver equipped with charging services will be dispatched to fulfill the need.
  • Scheduled Charge Option: Users may also schedule a charging session in advance, ensuring their vehicle will be charged at a time that is convenient for them.

6. Subscription Packages

To meet the diverse needs of our Users, the Service offers a range of Subscription Packages. Each package includes a predefined number of charging sessions per month and may vary in terms of the additional services offered. Users are encouraged to review the Subscription Package options within the App to select the one that best aligns with their charging frequency and service preferences.

7. Additional Services

In addition to charging services, the App may offer Users the option to access other vehicle- related services including, but not limited to, car wash, insurance, towing, and tire services. These services can be selected individually or bundled with your Subscription Package for additional benefits and savings.

8. Service Availability

The availability of our Instant Charge service is dependent upon the proximity and availability of our drivers equipped to provide charging services. During peak times or in areas with fewer available service providers, there may be delays. Furthermore, our Service is currently only available within the geographical confines of Dubai. Users located outside of this coverage area are unable to access the Service at this time. Users are advised to check the App for real-time information regarding the availability of drivers and the current coverage area.

9. Geographical Coverage

The Charger Electric Vehicle Charging Service is designed to serve customers within Dubai, United Arab Emirates. The current geographical coverage is limited to this region, and the Service is not available to Users located outside of these bounds. We aim to expand our coverage in the future and will update our Users as new locations are added. Users should consult the App for the latest information on the areas we cover.

10. Subscription Tiers and Limitations

Subscription tiers offered by the Service provide a range of options that cater to the varying needs of our Users. These tiers are structured based on the frequency of charging sessions, the inclusion of additional services, and other value-adding features or discounts. Each tier has its specific limitations and restrictions which may include a cap on the number of charging sessions per month or access to premium services. Users should review the terms associated with each subscription tier carefully before selection to ensure it meets their needs.

11. Fees and Payment Structure

The charging fees for using the Service are outlined as follows

  • For Instant Charge: 1 AED Per kilowatt + 35 AED service fee;
  • For Scheduled Charge: 1 AED Per kilowatt + 25 AED service fee.

Payment processing on the Platform, such as ordering services, may require you to furnish financial details (e.g., credit card information).

The total fee for each charging session will be calculated based on the kilowatt-hours consumed during the session plus the applicable service fee

12. Accepted Payment Methods

Our Service accepts various forms of payment for the convenience of our Users, including but not limited to Apple Pay, Google Pay, MasterCard, and Visa Card. To process transactions efficiently, ensure that all payment information provided is current and accurate. Changes to your payment method should be updated promptly in the App

13. Recurring Subscriptions

Users have the option to enroll in recurring subscriptions for continuous access to our charging services. The subscriptions are billed on a periodic basis as detailed in the subscription agreement. These subscriptions may include discounts, special promotions, and access to exclusive services. The Service reserves the right to modify the subscription terms, including prices and features, upon notice to the User.

14. Liability and Indemnification

The Company’s liability for any incidents or damages occurring during the charging process is limited to the fullest extent permitted by law. Users agree to indemnify, defend, and hold harmless CHARGER ELECTRIC VEHICLES CHARGING STATIONS MANAGEMENT & OPERATION L.L.C, its officers, directors, employees, agents, licensors, suppliers, and any third-party information providers to the Service from and against all losses, expenses, damages, and costs, including reasonable attorneys’ fees, resulting from any violation of these Terms or any activity related to the User’s account (including negligent or wrongful conduct) by the User or any other person accessing the Service using the User’s account.

15. Use of Geolocation

The Service requires the use of precise geolocation tracking to facilitate the delivery of charging services. Users must share their location with our drivers to receive the requested services. The Company is committed to protecting User privacy and employs industry- standard practices to safeguard geolocation data. Users may opt out of geolocation tracking; however, this will affect the functionality of the Service and the ability to provide charging services.

16. User Conduct

Users are expected to use the Service in a lawful and respectful manner. Any use of the Service that is fraudulent, abusive, or in violation of these Terms or applicable laws is strictly prohibited. The Company reserves the right to terminate access to the Service for Users who engage in prohibited conduct.

17. Service Cancellation by the Company

The Company may cancel the scheduled service due to unforeseen technical difficulties or system errors. In such instances, Users will be promptly notified, and any prepaid fees for the cancelled services will be credited back to the User’s in-app wallet.

18. Cancellation by User

Users may cancel a scheduled charge at any time through the App. However, please note that cancellations made by the User within 3 minutes after placing an order may incur a fee, which will be deducted from the refund credited to the User’s in-app wallet.

19. Changes to Scheduled Services

The Company reserves the right to make necessary adjustments to scheduled services, including rescheduling or changing the assigned driver, due to operational demands. Users will be informed of any significant changes to their scheduled services in advance whenever possible.

20. Service Availability and Interruptions

The Company will make reasonable efforts to ensure the Service is available at all times. However, the Service may be subject to interruptions due to maintenance, updates, and factors beyond our control. The Company will not be liable for any interruption in service and will seek to minimize any disruption where feasible.

21. Coverage Area Adjustments

The current coverage area for the Service is confined to Dubai, United Arab Emirates. The Company may expand or adjust the coverage area at its discretion and will update Users through the App regarding such changes.

22. Subscription Adjustments and Renewals

The Company may modify the terms of Subscription Packages, including prices and services offered. Users will be given notice of any changes prior to their subscription renewal date and will have the option to continue or cancel their subscription based on the new terms.

23. Payment Information and Security

Users must provide valid and current payment information for service fees and Subscription Packages. The Company employs secure transaction processing procedures but is not liable for any unauthorized charges made to your payment method by third parties.

24. User Responsibilities

Users are responsible for ensuring that their vehicle is compatible with the Service and that all information provided during the registration and charging process is accurate and complete. Users must follow all instructions provided by the Service for safe and effective charging of their vehicles.

25. User Data and Privacy

The Company is committed to safeguarding the privacy and security of User data collected through the Service. The collection, use, and disclosure of personal information are governed by our Privacy Policy, which is available on the App and the Site. Users consent to the processing of their personal data in accordance with this policy.

26. Compliance with Laws

Users agree to comply with all applicable laws and regulations in the use of the Service. This includes adhering to traffic and vehicle safety laws, as well as regulations concerning the use of mobile devices while driving.

27. Prohibited Conduct

The Service may not be used for any unlawful or prohibited purpose. This includes, but is not limited to, attempting to gain unauthorized access to the Service, interfering with the proper operation of the Service, or engaging in any activity that compromises the security of the Service or other Users’ data.

28. Dispute Resolution

Any disputes arising from or in connection with these Terms or the use of the Service shall be resolved through the courts of Dubai, United Arab Emirates, which shall have exclusive jurisdiction. This agreement is governed by the laws of the United Arab Emirates, without regard to its conflict of law provisions.

29. Changes to Terms and Conditions

The Company reserves the right to amend these Terms at any time. All changes will be posted on the App and the Site, and Users are encouraged to review the Terms periodically for any updates or changes. Continued use of the
